Terms and conditions
C1. Contract and scope
C1.1 These Terms govern the website and paid/free account services supplied by Clinical Knowledge Hub Pty Ltd (ACN 700 732 770; ABN 88 700 732 770) through www.clinicalknowledgehub.com.au (CKH, we, us). The products, price, access period and any institutional order accepted at checkout or by written agreement form part of the applicable contract.
C1.2 By actively accepting these Terms during registration or checkout, you agree to these Terms, Part A (Disclaimer) and Part D (Refund and Cancellation Policy), each as applicable to the supply purchased. Part B (Privacy Policy) and Part E (Cookie and Tracking Policy) explain our data practices; acknowledgement of those notices is not blanket consent to unrelated optional data uses.
C1.3 Viewing a public CKH post, free YouTube video or social-media channel without registering or agreeing does not, by that act alone, create a contract under these Terms. Relevant platform rules and applicable law still apply. If an institutional agreement expressly changes these Terms, that signed agreement prevails only to the extent of a conflict.
C1.4 CKH courses, memberships and other paid services are not offered to people located in, or ordinarily resident in, the United States of America or Canada (including their territories). Please do not register or buy from there. CKH may decline or cancel such a registration or order, and will refund any amount paid for an order it cancels.
C2. Eligibility, registration and account security
C2.1 Account holders must be at least 18 years old and ordinarily be a registered health practitioner or adult student undertaking recognised health-professional education. CKH may approve another appropriate health educator or professional in writing. We may reasonably request evidence of eligibility and refuse or suspend an ineligible registration.
C2.2 You must provide accurate and updated account information and safeguard your credentials. Accounts are issued to individual learners. You must not share accounts, claim another person’s learning, attempt to forge a certificate or permit simultaneous use of one named account by multiple people.
C2.3 Notify info@clinicalknowledgehub.com.au if you suspect a security problem. CKH may suspend access or sessions where reasonably necessary to protect the account, verify a suspected breach or prevent misuse, taking appropriate steps to avoid disproportionate harm.
C3. Licence for CKH content
C3.1 During the stated access period, CKH grants the eligible account holder a limited, personal, non-exclusive, non-transferable licence to view paid educational content for that person’s own learning and CPD, subject to payment where applicable. This is a licence to use content, not a transfer of intellectual property.
C3.2 You may download or print material only where CKH expressly offers that function, and then solely for your individual education and permitted CPD record-keeping. Except with CKH’s prior written commercial licence or as otherwise allowed by law or a third-party open licence, you must not sell, redistribute, republish, sublicense, upload to another platform, incorporate in a competing course, or use protected CKH diagrams, illustrations or content for training or commercial education. Restricted third-party images may be omitted from downloadable files.
C3.3 CKH may offer separate institutional group or teaching permissions by written agreement. Free YouTube content is accessed under the relevant platform terms and its applicable copyright/licensing rights, not through a general licence to reproduce paid CKH lessons.
C4. Intellectual property, open licences and acceptable use
C4.1 Subject to copyright actually subsisting and to any identified third-party rights, CKH owns or is licensed to use the original text, curriculum, assessments, scripts, photographs, videos, and original medical/artistic illustrations developed for CKH. This includes original hand-drawn and human-authored/edited artwork made with AI assistance to the extent protectable rights exist and have been assigned or licensed to CKH by their creators. Merely publishing a work on the site does not transfer a creator’s copyright to CKH; CKH obtains creator assignments or licences separately where needed.
C4.2 Except where a law or applicable third-party licence expressly permits it, you must not without CKH’s prior written permission: (a) reproduce, adapt, extract, sell, commercially display or distribute CKH-protected illustrations, course graphics, videos or other content; (b) use them in commercial training, paid clinical products, publications or promotional material; (c) scrape or systematically download content, bypass access controls, or use it to train, fine-tune, evaluate or ground an AI/model/retrieval service; or (d) remove author, copyright or source notices. Requests for commercial reuse and paid licences may be sent to copyright@clinicalknowledgehub.com.au.
C4.3 Material bearing a Creative Commons or other open licence may be reused to the extent the licence or law permits, even where CKH’s other content is more restricted. Comply with applicable attribution, licence-link, modification and ShareAlike conditions. A CKH contractual prohibition must not be read to impose additional restrictions on qualifying open-licensed material.
C4.3A AI-assisted works. Some CKH diagrams or images may have been developed with generative-AI tools. CKH does not claim exclusive copyright over a purely machine-generated component where copyright does not subsist, over the underlying facts of anatomy, or over material that belongs to third parties. Contractual restrictions apply to registered users to the lawful extent and do not extinguish statutory exceptions, open-licence rights or public-domain rights. CKH may separately protect the human-authored elements, edits, compilation, arrangement, branding and contractually restricted downloads.
C4.4 Use of third-party clinical images depends on the specific licence held by CKH. Do not extract, publish or redistribute restricted images unless permitted by the applicable licence or law. Do not try to identify a patient or person depicted in clinical teaching material.
C4.5 You must not disrupt systems, upload unlawful or infringing material, impersonate someone, interfere with verification functions, upload malware or misuse CKH communications or services. CKH may take proportionate measures to protect other users and the platform.
C4.6 Report a suspected copyright breach to copyright@clinicalknowledgehub.com.au, with the relevant material, rights claimed and contact details. CKH may temporarily restrict disputed content while it assesses the complaint.
C5. Learning service and access periods
C5.1 Each paid product page and the checkout will identify the content supplied, price, access period and applicable completion/certificate criteria. Each one-off purchase of a module or the full Program gives access for 12 months from the date of purchase, unless a different period is stated on the product page before payment. It is not an indefinite or lifetime licence. CKH may offer individual modules, the full Program, or both, as one-off purchases or as subscriptions; the product page states which. Monthly and annual subscriptions, where offered, provide access during the paid subscription period, subject to lawful changes, cancellations and CKH’s non-excludable obligations.
C5.1A Membership. A membership costs the price shown before payment and lasts 12 months from the date of purchase. While it is current: (a) you have access to Foundations of Clinical Assessment, with its CPD certificate when you meet the published requirements; (b) you pay the member price (10% off the listed price) for other courses and the full Program; and (c) a module or Program you have bought stays available past its 12 months until your membership ends. Membership does not renew automatically and is not a subscription: we email you before it ends and do not charge you unless you choose to renew and authorise payment. If you renew before it ends, the new 12 months start when the current membership ends. When it ends, Foundations access ends (unless you bought it separately and its 12 months have not ended), the member price stops, and each purchase stays available until 12 months after its own purchase date. CPD records and certificates are kept as described in Part B. Without a membership, selected Foundations lessons are free samples with no CPD certificate.
C5.2 CKH may correct, update or retire clinical content to maintain accuracy, lawfulness or copyright compliance. Where a material paid component is removed during its access period, CKH will offer a reasonable replacement or an appropriate remedy, without limiting the consumer’s choice of remedy where required by law.
C5.3 We may undertake planned or emergency maintenance. Temporary interruption alone does not necessarily breach a service guarantee; persistent or serious failure will be handled under applicable law and Part D. We will take reasonable steps to preserve continuity but do not promise uninterrupted access.
C5.4 A seven-day no-card free trial is available where advertised. It does not automatically become a paid subscription, and CKH will not charge a fee at the end of that trial unless you later choose to buy a paid product and authorise payment. Trial course or assessment completion may be stored as provisional evidence, but a paid CPD certificate is not issued during the trial.
C5.5 If you purchase qualifying paid access within 90 days after the recorded trial completion, CKH will recognise the eligible trial completion evidence retained in your account and will issue a certificate once the published course and payment requirements are met. The certificate shows the date on which the course was originally completed. Purchases made after that 90-day period do not guarantee that provisional trial work will be recognised; you may need to repeat the activity. A trial itself carries no certificate entitlement. These rules are subject to the Australian Consumer Law.
C5.6 CKH may give tester accounts by invitation only, for a limited period (ordinarily 15 days), to people helping to review the platform. Tester accounts do not create a CPD record or certificate entitlement.
C6. Group and institutional licences
C6.1 Institutional access is supplied only under a written institutional agreement or order, which states the number of named seats. Credentials cannot be shared. A named seat may be reassigned when the associated learner leaves, subject to the written agreement and reasonable access controls; reassignment must not falsify or transfer that person’s CPD history.
C6.2 Institutional customers are responsible for authorised seat allocation and agreed payments. CKH may provide only the institutional completion and enrolment data described in Part B and the applicable order, and will not automatically disclose full reflections or individual answer scripts.
C6.3 An institutional order should identify access dates, named-seat limits, fees, assignment rights, renewal/cancellation, relevant reporting, security and intellectual-property permissions. The order must not remove any non-excludable legal protection applying to that customer.
C7. Learner submissions and patient confidentiality
C7.1 You retain ownership of original reflections, support correspondence and other lawful material you submit. You give CKH a non-exclusive licence only to process, store, display to you as necessary, review for safety and provide the contracted services, maintain completion records, resolve disputes and prepare aggregated or genuinely de-identified operational analytics.
C7.2 Do not upload patient-identifiable information or confidential employer material without authority. Reflective practice must be appropriately de-identified. CKH may isolate, redact or remove prohibited information and investigate incidents; the presence of a contractual prohibition does not relieve CKH of any legal obligations relating to information it receives.
C7.3 You must have necessary rights and permissions for submissions. CKH will take reasonably proportionate action concerning unlawful submissions and will not take ownership merely because content is uploaded.
C8. Assessment, certificates and CPD evidence
C8.1 CKH may assign estimated CPD time, mark quizzes against predetermined criteria and issue a certificate only when the applicable published completion and payment conditions are satisfied. Work undertaken during a free trial may be recorded provisionally under C5.4–C5.5; it does not itself produce a certificate. An issued certificate evidences the recorded activity, not independent clinical competence or a regulator’s endorsement.
C8.2 A learner must decide whether a course satisfies requirements of the learner’s professional regulator, college or employer and keep independent records. Unless course information accurately identifies a specific and current accreditation, no accreditation or Ahpra approval is claimed.
C8.3 CKH may correct or revoke a certificate obtained through fraud, account sharing, error or materially inaccurate completion records, acting reasonably and keeping an appropriate audit trail. A refund alone does not establish that an honestly completed educational activity did not occur.
C8.4 Certificate status may be checked through the restricted verification method explained in Part B. Request a correction or privacy review by contacting privacy@clinicalknowledgehub.com.au.
C9. Pricing, subscriptions, auto-renewal and promotions
C9.1 Prices are stated in Australian dollars and exclude GST; GST is added at checkout and shown on the tax invoice. For individual learners, each price is shown with its total including GST, at least as prominently (for example, “$365 + GST ($401.50 total)”). Prices quoted to employers and institutions may be stated excluding GST only. The final checkout displays the amount payable, billing interval, initial/renewal price, subscription start and renewal date, any introductory period and how to cancel before payment is authorised.
C9.2 If you subscribe monthly or annually, the subscription renews for the same stated billing interval until cancelled. You authorise recurring charges at the rate shown at checkout or subsequently notified and accepted where required. You may cancel at any time in the account without needing to telephone CKH, or email info@clinicalknowledgehub.com.au if self-service cancellation fails.
C9.3 Cancellation normally stops the next renewal and access continues until the end of the period already paid for. We do not charge an extra cancellation penalty. Any statutory right to end the service earlier or obtain a refund overrides this arrangement.
C9.4 We will give reasonable advance notice of a material increase to a future renewal price (ordinarily at least 30 days) and a practical opportunity to cancel before it applies. A price change will not increase the amount payable for a period already purchased. Where consent is required by law, silence or continued use will not substitute for required consent.
C9.5 Any introductory or discounted offer will identify the discounted price, duration, eligibility and price payable afterwards before purchase. Discounts do not imply endorsement by any professional association or other third party.
C9.6 CKH will honour the stated conditions for periods already purchased. Unless the offer states otherwise, promotions cannot be combined.
C10. Refunds and payment disputes
C10.1 Part D explains cancellation, voluntary refunds and remedies. CKH does not provide refunds solely for change of mind, mistaken course selection or non-use, but that policy never limits rights under the Australian Consumer Law or other non-excludable law.
C10.2 If a transaction is duplicated or charged in error, contact CKH promptly. We will investigate and refund an established duplicate or unauthorised charge, subject to lawful fraud checks. Disputed charges should not automatically be treated as learner misconduct.
C11. Third-party sites, video and social media
C11.1 CKH may link to external guidelines, image publishers, tools, public YouTube videos and third-party services. Those services control their own content and may use cookies, present advertising and change availability. A reference or link is not automatically an endorsement.
C11.2 A YouTube video linked from a paid lesson, or shown as optional supplementary material where technically permitted, remains freely viewable on YouTube and is not a paid entitlement. CKH does not require watching a YouTube embed to pass a paid assessment, receive a certificate or complete a paid course. Core paid learning content is separately supplied by CKH or through appropriately licensed paid-course hosting.
C11.3 Third-party video use is subject to applicable YouTube or other provider rules, including restrictions on charging for embedded-player viewing. CKH may replace a video with an external link or remove an embed where necessary. Personal information collected by those third-party providers is handled under their own policies.
C12. Course representations and professional titles
C12.1 CKH offers education only and does not represent itself as a provider of patient-specific assessment, consultation or treatment. Presenters’ professional titles and qualifications will be represented accurately and must not imply professional-board endorsement or specialist status not held.
C12.2 Completion of CKH learning does not confer a professional registration, prescribing authority, procedural credential or other clinical privilege. CKH will not guarantee that a regulator or college will accept specific CPD hours except where an express, current and verified arrangement says so.
C13. Disclaimers and clinical reliance
C13.1 Part A forms part of the contract. CKH content is for professional education, not diagnosis or treatment of a particular patient. Practitioners remain responsible for exercising independent judgement, checking current sources and following the law and policies applicable to their setting.
C13.2 Nothing in the disclaimer or these Terms prevents a buyer from asserting statutory consumer guarantees or rights in relation to the quality or supply of CKH’s paid educational service.
C14. Liability and non-excludable rights
C14.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law).
C14.2 If the law permits CKH to limit a particular liability for failure to comply with a consumer guarantee relating to services, and applying that limitation is fair and reasonable in the circumstances, CKH’s liability for that failure is limited, at CKH’s option, to supplying the affected services again or paying the reasonable cost of their resupply. This clause does not operate where the law does not permit such a limitation or where the consumer has a non-excludable choice of remedy.
C14.3 For other contractual claims, and only to the extent legally permitted, CKH’s aggregate liability arising from the same event or connected series of events is capped at the greater of (a) the total fees actually paid by the claimant to CKH for the affected service during the twelve months before the event and (b) AUD 1,000. This cap does not apply to fraud, deliberate misconduct, a liability for personal injury caused by negligence that cannot lawfully be limited, or a liability which applicable law otherwise prohibits CKH from limiting. For clarity, the exceptions to this cap include liability arising from fraud, deliberate misconduct, or any intentional or reckless conduct constituting a serious invasion of privacy, or knowing and deliberate infringement of another person’s intellectual property rights. Nothing in this clause limits liability to the extent it cannot lawfully be limited.
C14.4 To the extent legally permitted, neither party is liable to the other for remote or indirect losses not reasonably contemplated when the contract was made. This clause does not exclude reasonably foreseeable loss or damage recoverable under non-excludable consumer guarantees or another applicable law.
C14.5 No part of these Terms requires you to indemnify CKH for liability caused by CKH’s own negligence, deliberate wrongdoing or breach of law.
C15. Limited user indemnity
C15.1 To the extent permitted by law, you agree to compensate CKH for direct and reasonably incurred third-party losses arising from your intentional unlawful activity on the platform, fraudulent certificate use, unauthorised redistribution of protected course content or knowing submission of unlawfully obtained personal information, but only to the extent the loss was caused by your conduct. CKH must take reasonable steps to mitigate loss and notify you of a claim in reasonable time.
C15.2 This provision does not apply to ordinary good-faith mistakes and does not displace consumer guarantees, reduce rights under applicable law or require you to pay for loss caused by CKH.
C16. Suspension, closure and termination
C16.1 You may close an account or cancel a subscription subject to its stated billing arrangements and mandatory rights. Before closure, download records you require. CKH may continue retaining a minimum lawful CPD audit record as described in Part B.
C16.2 CKH may suspend or end access for a material or repeated breach, fraud, non-payment or a material security risk, acting reasonably. Where practical, CKH will give notice and a reasonable opportunity to correct a remediable breach, and will consider whether a refund or other remedy is required because paid access is withdrawn.
C16.3 Account closure does not erase accrued contractual rights, lawfully retained completion evidence or rights and obligations intended to survive, including intellectual property and appropriate dispute resolution.
C17. Changes to terms and service
C17.1 CKH may prospectively update these Terms where reasonably necessary to comply with law, correct errors, protect security or privacy, respond to third-party rights, or make proportionate service improvements. CKH will not unilaterally reduce a substantive prepaid entitlement, increase an existing paid-period fee, or vary the agreed core product or course-access term to a customer’s material detriment simply by posting updated Terms. Changes needed immediately to address law, safety or security may take effect sooner, with notice as soon as reasonably practical.
C17.2 For a materially adverse proposed change affecting an ongoing paid service, CKH will give advance notice appropriate to its impact, ordinarily at least 30 days where practicable, explaining the effect, effective date, options to continue or cancel and any applicable refund or other remedy. Changes ordinarily take effect prospectively at renewal or for future purchases. Where a change deprives a user of a material prepaid benefit, CKH will seek agreement or offer a fair lawful remedy, including a proportionate refund where appropriate, without restricting any consumer-elected remedy under the ACL.
C17.3 New terms apply to existing prepaid contracts only to the extent expressly accepted by the customer or permitted by law and these Terms. Continued browsing or silence does not alone amount to consent where the law or the circumstances require an express agreement. Versioned acceptance records may be retained to evidence applicable terms.
C18. Disputes, law and general terms
C18.1 Contact info@clinicalknowledgehub.com.au about a billing or access complaint. We will try in good faith to resolve it promptly. Consumers may pursue remedies with the appropriate state or territory consumer protection body, tribunal or court; an ACCC complaint is not a substitute for deciding an individual’s refund dispute.
C18.2 Australian Capital Territory law governs these Terms, subject to any mandatory applicable consumer law. ACT courts have non-exclusive jurisdiction; this does not remove access to another court or tribunal where mandatory rights permit it.
C18.3 A provision unenforceable under applicable law is severed or read down only to the necessary extent; the rest continues. Non-enforcement on one occasion is not a waiver. CKH may assign receivables or transfer the business as part of a genuine sale or reorganisation, subject to confidentiality, applicable privacy law and the safeguards in C18.4. Learners may not sell or transfer a personal account or certificate to someone else.
C18.4 CKH will not transfer a material ongoing obligation to an unrelated provider where this would materially reduce contracted service quality, security or enforceability without providing reasonable notice and, where required, consent or a meaningful cancellation and appropriate refund option. A transferee assuming outstanding services must be capable of providing them; existing non-excludable legal rights remain enforceable. CKH may use ordinary processors/subcontractors to perform services while remaining responsible for its own obligations to the extent required by law.
